Q: Is this something that needs staked down?

As long as it is placed somewhere where there are no strong winds, it does not need to be staked down. I put mine in a bush where it looks like it is coming out of the bush....pretty cool.

Q: How do you get the head to stand up when it is on the ground? Mine just lays flat.

Mine also lays flat. You have to find something to prop it up.

You can make it come out of the window. The hands are not flexible though.
